Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of etsaP (the “Software”) and related websites, including the landing page and licensing portal (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Who we are

The Service is provided by AthelneySoft (“we”, “us”, or “our”), based in British Columbia, Canada. Contact: support@athelneysoft.com.

2. License & access

  • We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on desktop devices you own or control, in accordance with your purchased license.
  • You may not copy, modify, decompile, reverse engineer, or redistribute the Software except as expressly permitted by law.
  • Account creation may be required. You are responsible for maintaining the confidentiality of your credentials.

3. Trials, payments, and refunds

  • If a free trial is offered (e.g., 30 days), you may use the Software during the trial. Continued use after the trial requires a paid license.
  • Payments are processed by third-party processors (e.g., Stripe). We do not store full card details.
  • For installment plans (e.g., 6 monthly payments), you authorize recurring charges until the plan completes or is cancelled before the next charge. After all payments are completed, your access becomes lifetime.
  • Refunds, if provided, are described in our Refund Policy (if applicable). Otherwise, all sales are final except where required by law. Chargebacks may result in immediate license suspension while we investigate.

4. Acceptable use

  • Do not misuse the Service, interfere with its operation, or attempt unauthorized access.
  • Do not use the Service to violate any law or the rights of others.
  • We may suspend or terminate access for violations.

5. Intellectual property

The Software and all related content are owned by us and our licensors and are protected by intellectual property laws. No rights are granted except as expressly stated.

6. Updates & changes to the Service

We may provide updates, including security fixes and feature improvements. Updates may be required to continue using the Service. We may modify or discontinue features with reasonable notice when practical.

7. Disclaimers & limitation of liability

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties and limit liability for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim is limited to the amount you paid for the license in the 12 months preceding the claim.

8. Governing law & disputes

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of laws principles. Courts located in British Columbia will have exclusive jurisdiction, unless applicable consumer laws require otherwise.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access for breach of these Terms or for misuse. Upon termination, your license ends and you must uninstall the Software.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the new Terms here and update the “Last updated” date. Continued use after changes means you accept the updated Terms.

Privacy Policy

This Privacy Policy explains how AthelneySoft ("we", "us") collects, uses, and protects personal information when you use etsaP and our related websites.

1. What we collect

  • Account data: email address and authentication information via Firebase Authentication.
  • License & purchase data: limited billing metadata from our payment processor (e.g., transaction ID, last 4 digits, expiry month/year). We do not store full card numbers.
  • Error/diagnostics (optional): automated error or performance reports (e.g., timestamps, app version, OS, non-content logs, stack traces) sent via Firebase services or our functions. You can opt out in the app settings to stop new automatic reports.

2. How we use data

  • To create and secure your account, verify license status, and provide the Service.
  • To process payments and manage subscriptions or installment plans.
  • To communicate important updates, security notices, or changes to terms.
  • To analyze and improve the Software and user experience (in aggregate or anonymized form).

3. Legal bases

Where required (e.g., under GDPR), we rely on one or more legal bases: performance of a contract (providing the Service), legitimate interests (improving and securing the Service), compliance with legal obligations, and your consent (where applicable, e.g., for marketing or optional analytics).

4. Sharing of information

  • Service providers: We share data with vendors that help us operate the Service, such as Firebase (authentication, hosting, database) and Stripe (payments). See their privacy notices: Firebase Privacy, Stripe Privacy.
  • Legal and safety: We may disclose information if required by law or to protect rights, safety, and security.
  • No selling of personal data: We do not sell or rent your personal information.

5. Data retention

We retain personal information for as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Optional error telemetry may be retained for up to 12 months. If you delete your account, we will delete or anonymize your personal information within a reasonable period, except where retention is required by law.

6. Your rights

  • Access, update, correct, or delete your personal information.
  • Object to or restrict certain processing, and withdraw consent where processing is based on consent.
  • Request data portability of information you provided.
  • Lodge a complaint with a data protection authority if you believe your rights are infringed.

7. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information, including relying on Firebase’s security features. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. International transfers

Our service providers may process data outside your province or country (including the United States). Where applicable, we take steps to ensure adequate protection for such transfers.

9. Children’s privacy

The Service is not directed to children under 13. If you believe we have collected information from a child in violation of law, contact us and we will delete it.

10. Changes to this policy

We may update this Privacy Policy periodically. We will post the updated version here and update the “Last updated” date. Material changes may be communicated by email or in-app notice.
